NanoAI Cloud Terms of Service
Last updated November 7, 2026
NanoAI Cloud (called Nano Cloud in the app) is a service of Omega AI LLC, a Louisiana limited liability company ("Omega AI", "we", "us"). It runs the hosted AI model that NanoAI, the app on your PC, can use. NanoAI itself is free to use with a model that runs on your own PC; these terms cover NanoAI Cloud, the hosted model, and the account and plans that go with it, and what NanoAI does on your PC. When you buy a plan, you agree to these terms at checkout; by creating an account or linking a PC, you agree to them and to our privacy notice.
Who can use it
You must be at least 18, or the age of majority where you live if that is higher, to have a NanoAI Cloud account. If you use it for a business, you confirm you may accept these terms for that business.
NanoAI Cloud plans are sold only in the United States. By buying one, you confirm you are in the United States. If a plan or a weekly limit reset is bought from outside it, we may cancel it and refund what was paid.
Your account
- You sign in with a verified email address. Keep your sign-in to yourself.
- You are responsible for the PCs you link to your account and for everything sent from them. Your plan works on every PC you link, and their use counts together. Unlink a PC on your account page if you lose it or stop using it.
- Don't share, sell or resell access to your account or to NanoAI Cloud.
Plans and billing
- Paid plans are subscriptions, monthly or yearly, billed in advance through Stripe. The price, how often it renews and how to cancel are shown before you pay. Every plan includes all of NanoAI's capabilities; plans differ only in how much hosted model use they include.
- Your subscription renews automatically at the end of each billing period, at the same price, until you cancel. Sales tax is added where it applies, worked out from the country and postal code you give at checkout.
- You upgrade, downgrade or cancel online, any time, with Manage billing on your account page. An upgrade starts at once, and the difference for the rest of the period is charged then; a change from a yearly plan to a monthly one starts at the end of the year you paid for. A downgrade or a cancellation takes effect at the end of the period you have paid for, and your plan keeps working until then.
- If we change a plan's price, we will tell you at least 30 days before it applies to your next renewal, so you can cancel first.
- We won't lower a plan's allowance during a period you have paid for. A lower allowance applies from your next renewal, and we tell you at least 30 days before.
Weekly allowance and weekly limit resets
- Each plan includes a weekly allowance of hosted model use, shown as a share used on your account page and in NanoAI. Your week starts again every 7 days, counting from when you subscribed, on monthly and yearly plans alike. There is no daily limit: you can use the week's allowance in one go or spread it out. When it is used up, NanoAI Cloud stops answering until your week starts again, you upgrade, or you buy a weekly limit reset. NanoAI keeps working with a model on your own PC.
- A weekly limit reset is a one-time purchase, available on every plan, that starts a fresh week of your plan's allowance right away. Your next week then starts 7 days after the reset. Unused allowance does not carry over from one week to the next.
Refunds
- Payments are non-refundable, except where the law requires a refund or as these terms say. Cancelling stops the next renewal; it does not refund the current period.
- If you are charged twice or charged by mistake, or a weekly limit reset you paid for cannot be applied to your account, we refund it.
- Where the law gives you a right to cancel and get your money back, you have that right. Email us to use it.
- If we shut NanoAI Cloud down, we refund the unused part of any period you have paid for.
Failed payments
If a renewal payment fails, Stripe tries it again over the following days and your plan keeps working meanwhile. If it still fails, your subscription is cancelled. You can choose a plan again at any time.
Acceptable use
Don't use NanoAI Cloud to:
- break the law, or help anyone else break it;
- make or share content that sexualizes minors, promotes violence or self-harm, harasses people, or infringes others' rights;
- write malware, attack systems, or send spam or scams;
- break the rules of the services NanoAI Cloud is built on, including Microsoft's Code of Conduct for its Azure AI services and the Azure OpenAI acceptable use rules;
- get around your plan's limits, use NanoAI Cloud other than through NanoAI, or take apart, copy or overload the service.
Calls are checked for abuse automatically, as the privacy notice describes. We may suspend an account while we look into possible abuse; an automatic suspension lasts up to 24 hours unless we extend it after review, and a suspension does not pause your subscription. We may block an account for serious or repeated abuse. Blocking an account unlinks its PCs and cancels its subscription at once, without a refund. To report abuse, email nanoai@omega2ai.com.
Your content
What you send to NanoAI Cloud and the answers you get are yours, as far as we are concerned. You give us only the rights we need to run the service: to pass your requests to the AI model and its answers back to you. We don't use your content to train AI models. Answers are made by an AI model, so someone else may get a similar one.
AI answers
Answers come from an AI model and can be wrong, incomplete or out of date. They are not professional advice, such as legal, medical or financial advice. Check anything that matters before you rely on it or act on it.
What NanoAI does on your PC
NanoAI can act for you on your PC and in your accounts. It can run programs and commands; open, change, move and delete files; fill in and submit forms; send email and messages; and use the apps, websites and plugins you connect. It does this on your instructions, and it works out how to carry them out from an AI model's answers, which can be wrong. This section applies whichever model NanoAI uses, NanoAI Cloud or one on your own PC.
- You decide whether to install NanoAI, which features and access to turn on, and what to ask it to do. You are responsible for everything NanoAI does on your PC and in your accounts, and for the results. That includes when NanoAI misunderstands you, makes a mistake, or carries out an instruction differently from what you meant.
- Some actions can't be undone, such as deleting files, sending a message or paying for something. Keep backups of anything that matters, and don't give NanoAI access you aren't willing to have used.
- To the fullest extent the law allows, Omega AI is not responsible or liable for any action NanoAI takes or fails to take, or for any loss or damage that results. That includes lost or damaged data, files, devices or accounts, messages sent, purchases made, and claims by other people.
- You agree to cover Omega AI's losses and costs, including reasonable legal fees, from any claim by someone else that arises from what NanoAI did on your instructions or with the access you gave it, or from how you used it.
Copyright
If you believe something made available through NanoAI Cloud infringes your copyright, email nanoai@omega2ai.com with the work, where you found the infringing material, your contact details, and a statement that you are the owner or authorized to act for the owner.
Changes to the service
We keep improving NanoAI Cloud and may change, add or remove features, including the AI model it uses. If a change takes away something that matters to a plan you pay for, we will tell you before it happens.
Ending your account
You can cancel your plan at any time on your account page, and ask us to delete your account by emailing nanoai@omega2ai.com. Deleting your account ends your subscription at once, without a refund for the rest of the period; to keep using your plan until the period ends, cancel it first with Manage billing and ask us to delete your account after that. We may end or suspend your access if you break these terms, or if we must for legal reasons. These sections still apply after your account ends: Your content, what NanoAI does on your PC, the disclaimer, the limit of liability, and governing law.
Disclaimer
NanoAI and NanoAI Cloud are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including that they will always be available, uninterrupted or error-free, or that answers or actions will be accurate, safe or fit for a particular purpose.
Limit of liability
To the fullest extent the law allows, Omega AI is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from NanoAI Cloud or from what NanoAI does on your PC. Our total liability for any claim about NanoAI or NanoAI Cloud is limited to the greater of what you paid us for it in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not all apply to you. Nothing in these terms limits rights you have as a consumer that the law says cannot be limited.
Governing law and disputes
These terms are governed by the laws of the State of Louisiana and the United States, without regard to conflict-of-laws rules. Please email us first: most problems can be solved that way. If a dispute can't be resolved, it goes to the state or federal courts located in Louisiana, and you and we agree to their jurisdiction. Either of us may instead bring a claim in small-claims court where you live, if it qualifies. If you are a consumer in the European Union or the United Kingdom, you can also bring a claim in the courts where you live, and the consumer protections of that country's law still apply.
Changes to these terms
When we change these terms, we update the date at the top. If a change matters to you, we tell you by email or in NanoAI at least 14 days before it takes effect. If you keep using NanoAI Cloud after that, the new terms apply; if you don't agree, cancel before then.
